The new Iowa statute provides for an electronic database, the Mechanic’s Notice and Lien Registry (MNLR), where residential notices and all liens and suits are to be posted beginning January 1, 2013. Generally, the requirements include:
For residential projects (single- or two-family dwellings):
* General Contractors / Owner/Builders who will subcontract must post a Notice of Commencement to the MNLR and a copy must be served on the owner.
* General Contractors who subcontract must also serve a separate written notice to the owner.
* Subcontractors may post a Notice of Commencement to the MNLR if not posted by the general contractor or the owner/builder.
* Subcontractors mustpost a preliminary notice on the MNLR, serving a written copy of the notice on the owner.
For commercial projects, the notice requirements remain unchanged.
Mechanic’s Liens, and suit to enforce the liens, must be posted to the MNLR for both residential and commercial projects.
